This course analyses fundamental problems of private law: What is private law?, The declaration of intent: nuclear physics of private law or German abstraction?, The concept of „persona“, From status to contract and all the way back?, Freedom of contract, Transfer of ownership, Roman family as a model for a secular society?, The testator’s will and the family’s expectations, Interpretation: a psychological or a normative process?. These topics will be dealt with from a historical perspective, which might be either some kind of genealogy from Roman to modern law or simply an analysis of 19th century and later developments. The analysis will also be comparative taking into account other legal systems to the extent that seems fruitful. On the whole the goal of this course is to create a playful sensibility for private law. Following topics will be discussed in cthe classroom: • What is Private law, just law or what respect can it be differentiated from Public law? • Methods of Private law: anything goes? • History of Private law: useless waste of time? • Comparative law: and if the others are wrong? • System of Private law: cage dancing? • The declaration of intent: nuclear physics of Private law or German abstraction? • The concept of „persona“: Phrygian cap or shirt of Nessus? • Consumer law: A golden cage for overfed hens? • From status to contract and all the way back? • Penalty clauses: forever torn between two extremes • Transfer of ownership: extremes, compromises and happy eclecticism • Retention of ownership clauses: the magic of construction • Freedom of contract, Transfer of ownership, Roman family as a model for a secular society? • The testator’s will and the family’s expectations, Interpretation: a psychological or a normative process? • Action or claim or what? |
