The program of the course is based on the assumption that the student should have an in-depth knowledge of the legal mechanisms guaranteeing compliance with European Union law by its bodies, as well as by the Member States and other participants in legal relations. The aim of the course is to develop the ability to interpret legal provisions in order to solve legal problems related to the application of European law. The student will acquire knowledge, thanks to which he will learn about the relationship between legal protection at the national and EU level.

The course analyzes issues related to the institution of legal protection of the European Union, in particular: functions, competences, organization, and the manner of operation of legal protection authorities in the context of protection of the EU legal order.

The aim of the classes is to get to know and understand by students how the activities of participants in legal relations are secured in the European Union in the manner provided for by the provisions of European Union law and in order to implement applicable legal acts. The issues in question are analyzed in the dimension of the bodies of the European Union, public authorities of the Member States, as well as in the dimension of subjective rights.

The course covers the issues of the EU system of sources of law and the principles of its interpretation. The system of legal protection authorities of the European Union and the issues of legal consequences of violating the provisions of European Union law are analyzed.

1. Sources of European Union law

Primary law of the European Union. European Union secondary law: binding and non-binding. Case law of the Court of Justice. Internal law acts.

2. Principles of application of European Union law

Priority rule. Principle of direct effect. The principle of indirect effect. Principle of Member State liability for breach of EU law.

3. System of legal protection authorities of the European Union

The concept of legal protection. Legal remedies. Legal protection authorities: Court of Justice of the European Union - Court of Justice, General Court, specialized courts.

4. The Court of Justice of the European Union

Court of Justice, General Court, European Union Civil Service Tribunal - scope of competence, composition. The role and nature of the jurisprudence of the Court of Justice.

5. Procedure before the Court of Justice

Parties and participants in the proceedings. Written procedure and its stages. Oral procedure and its stages. The preliminary ruling procedure. Burden of proof. Evidence in the proceedings before the Court of Justice. The burden of proof. Language of the proceedings. Types of judgments of the Court of Justice. Appeal procedure (appeal and review). Costs of the proceedings. Procedure for the enforcement of judgments of the Court of Justice.

6. Action against a Member State under Art. 258-260 TFEU

Legal grounds for the complaint. The subject of proceedings under Art. 258, with art. 259 and art. 260 TFEU. The stages of the procedure. Subjects of the procedure - active ID and passive ID. Judgment. The difference between a procedure initiated by the Commission and a procedure initiated by a Member State.

7. An action for annulment of an act of an institution, body or office of the European Union pursuant to Art. 263 TFEU

Legal grounds for the complaint. The nature and subject of the complaint under Art. 263 TFEU. Acts subject to challenge (non-binding secondary legislation nature). Personal scope of the complaint - entities with active legitimacy and passively legitimated entities. Formal requirements of the complaint. Grounds for invalidity. Time limit for lodging a complaint. The burden of proof. The effects of a judgment pursuant to Art. 263 TFEU.

8. Action for failure to act by an institution, body, office or agency of the European Union

Legal grounds of the complaint. Nature and subject matter of the complaint. The subjective scope of the complaint - entities with active and passive legitimacy. The concept of unlawful inactivity. Burden of proof. Effect of the judgment.

9. EU action for damages

Legal grounds for the complaint. Nature and material scope of the complaint. Types of liability: contractual liability, tort liability. Premises of tort liability. The subjective scope of the complaint - entities with active and passive legitimacy. Limitation period. Effect of the judgment.

10. The procedure for submitting preliminary questions

Legal basis of the questions referred for a preliminary ruling. The function of preliminary questions. Reference from a national court of a Member State for a preliminary ruling. The concept of a court and a court of last instance. The subject of the preliminary question. The acte clair doctrine and the acte eclaire doctrine. The effects of a preliminary ruling.

The genesis and nature of the ERPO institution, the scope of competences and forms of operation.

Genesis and character of the European Public Prosecutor's Office, property, local and personal jurisdiction and forms of operation.

14. Protection of fundamental rights in the European Union

Protection of fundamental rights as general principles of law. Evolution of fundamental rights. Charter of Fundamental Rights. Application of the Charter of Fundamental Rights.
