Short description:

The objective of the lecture is to present the issue of the protection of fundamental human rights and freedoms in the context of existing international legal instruments adopted under the auspices of the Council of Europe, in particular the European Convention on Human Rights. The main objective of the course is to demonstrate the characteristics and the leading role of the European instruments and their application in the field of international human rights.

a. the European Convention and its Protocols – their relations

b. the catalogue of rights and freedoms guaranteed by the Convention and Protocols

c. the special nature of Protocol 12

d. the system of controlling compliance with obligations:

i. types of complaints and the question of their admissibility,

ii. bodies involved in the control process until 1998

iii. bodies involved in the control process since 1998

Learning outcomes:

The student understands the systems of human rights protection within the Council of Europe and the European Union.

The student has ability to outline the course of proceedings before the European Court of Human Rights.

The student has ability to assess the factual circumstances in which reference should be made under a particular legal system and the factual circumstances in which to use specific remedies provided for by the systems.

- kontrola obecności – potwierdzona listami obecności;

- ocena ciągła polegająca na sprawdzeniu przygotowania do zajęć oraz aktywności podczas zajęć (w przypadku nieobecności – możliwość zaliczenia ustnego, przygotowania pracy pisemnej – według wyboru osoby prowadzącej zajęcia);

- egzamin ustny
