The objective of the lecture is to present the issue of the protection of fundamental human rights and freedoms in the context of existing international legal instruments adopted under the auspices of the Council of Europe, in particular the European Convention on Human Rights. The main objective of the course is to demonstrate the characteristics and the leading role of the European instruments and their application in the field of international human rights. |

The Commissioner for Human Rights – his role and functions. 2. The system of the European Convention for the Protection of Human Rights and Fundamental Freedoms a. the European Convention and its Protocols – their relations b. the catalogue of rights and freedoms guaranteed by the Convention and Protocols c. the special nature of Protocol 12 d. the system of controlling compliance with obligations: i. types of complaints and the question of their admissibility, ii. bodies involved in the control process until 1998 iii. bodies involved in the control process since 1998 3. Learning outcomes: |
The student understands the systems of human rights protection within the Council of Europe and the European Union. The student has ability to outline the course of proceedings before the European Court of Human Rights. The student has ability to assess the factual circumstances in which reference should be made under a particular legal system and the factual circumstances in which to use specific remedies provided for by the systems. |
