Short description:

In the framwork of the subject student is to get basic knowledge about the methods and concepts applied in the process of analysis of criminal justice system in the field of sociology, anthropology, history and penologyiquestions of the genesis and evolution of punishment, and the historical changes in the criminal justice systems.

Full description:

In the framwork of the subject student is to get basic knowledge about the methods and concepts applied in the process of analysis of criminal justice system in the field of sociology, anthropology, history of criminal law and penology. In the lecture examples will be emphasized related to the history, especially to the ancient history and related to the anthropological analysis of the conditions of development of European penal cultures. To illustrate certain special problems and social and cultural mechanisms also examples related to the penal institutions from other past and contemporary penal cultures will be examined, with special attention to the chances and problems of multiculturalism. Historical and anthropological analysis will be commented in relation to the different sociological theories of conflict. The lecture will focus also on the analysis of socio-cultural conditions of the use of social patterns related to the ancient tradition amd symbolic of Bible in the context of shaping modern Western (European) penal systems from the second half of XVIII century to the contemporary times. In this anaysis the possible interrelations between the development of modern penal doctrines, and theories, the criminal law based on knowledge , cultural heritage and symbolism of punishment and the needs of new capitalist economy and new State order based on the rule of law, biurocracy and democratic principles will be discussed.

Literature for the classes and for the written exam will be provided each academic year at the first meetings by the persons responsible for the history, sociology and social anthropology.

Learning outcomes:

Student shall be able to use knowledge of sociology, history, social anthropology and legal studies to multidimensional (culturally integrated) analyses of the criminal justice systems in the diachronic and synchronic way. Especially the student shall have the basic knowledge which helps to identify socio-cultural factors which may today inluence the process of enacting and implementing the legal ruiles of penal law and also determinating their effectveness and conformity to the axiological system of State (Constitution) and society.

As a result of the course, students should acquire knowledge about the relationship between punishment and other spheres of symbolic culture associated primarily with creating and maintaining perceptions regarding the social order, preventing the disorder and finding compromises between conflicting attitudes tolerated each other socially

Moreover students will have a knowledge and comptetences for analyses of criminal law provisions, contemporarty and historical, the competences in respect of methodologically correct analysis of historical documents concerning punishment, including also documents of Ancient Civilisations, and the knowledge concerning the reality of criminal justice system in the history, i.a by the analyses of different types of criminal process.

Assessment methods and assessment criteria:

Classes: student's activities, permanent evaluation, student, may, for instance, present a paper. Moreover, to get credit for the classes and for exam it is necessary to pass a written exam. The written exam is indispensable to get credit for classes and the appriopriate number of points is also enough to pass the exam with the minimum grade. To get a better grade at the exam it is necessary to pass well the oral exam following the written test.
