Short description:

The tutorials prepare for the examination from the course titled Law of the European Union through analyzing of the case-law of the CJEU. It aims to explain basic legal terms, notions and concepts presented during the lectures.

Full description:

The tutorials are based on CJEU case-law analysis. Students prepare for the classes by reading selected court judgements that are analyzed by whole class.

The following case-law of the CJEU is analyzed:

1. Character of the EU and its importance to individuals, fundamental principles of which EU is based (principles of autonomy, primacy, proportionality, subsidiarity)

2. Sources of EU law

a) primary legislation (treaties, EU Charter of fundamental rights)

b) secondary legislation (regulations, directives, decisions, soft-law)

3. Application of EU law in member states

a) direct effect

b) indirect effect

c) incidental effect

d) state liability for the damage caused by breach of EU law

4. Individuals in the EU legal order, EU citizenship

5. External relations of the EU

6. EU law and Polish law

After completion of the course the student

- Determines the basic legal concepts established in the case law of the ECJ,

- Reads with understanding CJEU judgments in Polish,

- Analyzes the case law of the CJEU.

- Can identify key legal issues of a given judgment

- Determines how judgments relate to previous case law

- He/she is aware of European legal culture.

at least mark 3 (satisfactory) from all tests
