Short description:	Presentation of methodology and most important notions of the EU/EC institutional law. Introducing EU legal instruments in foreign languages. Demonstrating a position of the EU/EC in the international community and international legal order. Discussing application of European law in domestic legal orders of the Member States.
Full description:	Main goal of the subject is to present the most important institutions, structure of EU agencies, their functions, procedures and mutual relations, legal personality of the EU, sources of law, and principles of organization and functioning of the EU legal order. Particular role of the jurisprudence of the Community courts in the shaping and application of European law will be emphasized, as well as practical consequences of the introducing of EU law into the domestic legal orders of the Member States (including the jurisprudence of the Polish Constitutional Court and interactions between Community and domestic judges). Solutions proposed in the Treaty of Lissabon will also be discussed. The lectures are based upon a dialogue with the students, who are expected to participate actively in the presentations and get an opportunity to confront their theoretical knowledge with practice and possible future professional activities. Fundamental ideas of European integration. Legal personality and mutual relations between the European Union and European communities - 4 h. Institutional principles of the EU: democracy and rule of law, subsidiarity and proportionality, loyal cooperation, non-discrimination, institutional balance, division of powers between the EU and Member States - 6 h. Principles of operation of European law: direct applicability, direct effect, relations between EU law and municipal legal orders of the Member States - 4 h. Primary law (founding treaties, customary law, general principles) - 4 h. Secondary law (regulations, directives and their implementation, decisions, non-binding acts) - 6 h. EU in international relations; treaty-making power - 6 h. The preparation to the classes requires reading of the EU legal texts and case-law in English, French or German language. Learning outcomes:	After completing the course the students will: Knowledge: – know the institutions of the EU and Community law, – know the institutional structure, functions, rules of appointment of EU bodies and the relations between them, – understand the legal personality of the EU/EC, – know the sources of EU law, – know the structural and functional principles of the European legal system, – knows selected judgements of Community courts and understands their role in shaping EU law, – understands the practical consequences of introducing EU law into the internal legal systems of the Member States, – knows selected relevant judgements of national courts (including the Polish Constitutional Tribunal), Skills: – be able to apply his/her knowledge for practical professional purposes, – be able to participate in a discussion, – efficiently communicate his/her opinions on EU law and case law, – have the ability to correctly interpret EU legislation and case law, – be able to express himself/herself in writing on the subject of EU law and case law, – be able to prepare a selection of EU laws and judgements applicable to a given subject, – know EU legal terminology in a foreign language, – read relevant academic literature in foreign languages, – read EU legislation and judgements in foreign languages, Social competences: – be aware of the importance of legal rules, – be a conscious EU citizen, – be aware of the need to keep updating the knowledge of EU law.
