The course is based on analysis of legal instruments in the area, including but not limited to public procurement directives, case-law of the Court of Justice of the European Union and relevant legal literature. |

(tylko po angielsku) The subject-matter of the course is the European Public Procurement Law. According to the European Commission every year over 250 000 public authorities in the EU spend around 20% of GDP on the purchase of services, works and supplies. Public procurement is therefore a concrete expression of the fundamental freedoms of the internal market, in particular the free movement of goods and services. The course is based on analysis of legal instruments in the area, case-law of the Court of Justice of the European Union and legal literature. Content of the course: Objectives and method of regulation. Definitions. Public contracts and concession contracts. Sources of European Public Procurement Law. Public contracts within the Treaty but outside the Public Procurement Directives. Procurements within the Treaty and the Public Procurement Directives. 2014 reform of European Public Procurement Law. Principles of European Public Procurement Law: non-discrimination, equal treatment and transparency. Overview of the Public Sector Directive and the Utilities Directive. Defense Procurement. Overview of the Remedies Directive. |
