ECTS credit allocation (and other scores): 12.00 Basic information on ECTS credits allocation principles:
  • the annual hourly workload of the student’s work required to achieve the expected learning outcomes for a given stage is 1500-1800h, corresponding to 60 ECTS;
  • the student’s weekly hourly workload is 45 h;
  • 1 ECTS point corresponds to 25-30 hours of student work needed to achieve the assumed learning outcomes;
  • weekly student workload necessary to achieve the assumed learning outcomes allows to obtain 1.5 ECTS;
  • work required to pass the course, which has been assigned 3 ECTS, constitutes 10% of the semester student load.

Prerequisites (description):

The seminar will cover a wide and up-to-date spectrum of legal problems related to the membership of the state (especially Poland) in the European integration processes. The main point of reference will be the application of European Union law by national courts and their dialogue with the Court of Justice of the European Union. This dialogue takes place primarily through the preliminary ruling mechanism. The problems the seminarians will deal with during the classes will largely depend on the interests of students. Before the classes, a survey will be carried out that will allow them to be specified.

Short description:

The subject of the seminar covers the entire spectrum of European Union law - and the choice of topics is made by the seminarians themselves, specifying their interests. Work at the seminar will consist in the selection of the problem in terms of doctrine and the example of its judicial application by national courts, as far as possible in the sequence of interpretation (in the preliminary ruling procedure) of the CJEU and application by national courts, examples of such a sequence are cases of Swiss franc loans, protection consumer, environmental protection, many issues related to the internal market and human rights.

The Polish legal order, since the accession to the EU, i.e. from 1 May 2004, consists of, taking into account the subjective aspect, i.e. the legislator, the subsystem of EU law, established by a specific EU legislator, and the subsystem of Polish law, established by the national legislator . From the point of view of the subject, the Polish legal order is a monistic one, because the EU law is part of the national legal order.

However, the interaction between EU law and national law is complex and governed by general principles such as the principle of direct effect of EU law, the primacy of that law and the principle of effectiveness.

These principles define the legal nature of the relationship between the EU law system and the national law system, define the position and tasks of the national courts of the Member States in the process of interpreting and applying the law of both systems, but also (which is the most difficult) national administrative authorities.
