  • the annual hourly workload of the student’s work required to achieve the expected learning outcomes for a given stage is 1500-1800h, corresponding to 60 ECTS;
  • the student’s weekly hourly workload is 45 h;
  • 1 ECTS point corresponds to 25-30 hours of student work needed to achieve the assumed learning outcomes;
  • weekly student workload necessary to achieve the assumed learning outcomes allows to obtain 1.5 ECTS;

Prerequisites (description):

All law students are welcome. Students with EU-law background will find the subject easier. Students with background in domestic competition law, coming from EU member states, may find the subject reduntant as competition rules are largely similar between the EU and its member states.

Short description:

The lecture concerns three subjects: prohibition of anti-competetive agreements (as well as concerted practices and decisions by associations of undertakings), prohibition of abuses of a dominant positions, and proceedings in these cases.

– Terminology employed in competition law.

– Competences of the European Commission and national competition authorities re EU competition law.

– Anticompetitive agreements and methodology of their assessment applied by the European Commission and the European Courts.

– Main types of the anticompetitive agreements.

– Rule of reason.

– Block exemptions and de minimis rule.

– Dominant position.

– Abuse of a dominant position and its assesment.

– Remedies.

– Proceedings before the Commission and leniency programme.

– Private enforcement of EU competition rules.

Learning outcomes:

Acquiring knowledge regarding EU rules on anti-competetive agreements, concerted pracitces and decisions by associations of undertakings, as well as abuses of a dominant position. Learing basic skills in clearing contracts and terms and conditions with regard to their compliance with competition law.
