  • the annual hourly workload of the student’s work required to achieve the expected learning outcomes for a given stage is 1500-1800h, corresponding to 60 ECTS;
  • the student’s weekly hourly workload is 45 h;
  • 1 ECTS point corresponds to 25-30 hours of student work needed to achieve the assumed learning outcomes;
  • weekly student workload necessary to achieve the assumed learning outcomes allows to obtain 1.5 ECTS;

Prerequisites (description):

The specialization lecture is devoted is to introduce students to key issues related to employment support programs (in particular, the conditions for providing such support) and to familiarize students with issues related to the protection of employee claims.

Short description:

During the course will be presented the conditions for providing assistance for subsidizing the employment of employees (both disadvantaged and disabled employees) in the light of the EU rules on granting public aid. The course will also cover issues related to the protection of employee claims, in particular the approximation of the Guaranteed Employee Benefits Fund and the benefits paid out from it.

The lecture will also discuss the issue of remuneration for work and other work-related benefits and protection of remuneration for work under the Labor Code

Full description:

The main direction of reflection during the classes will be, among others the following issues:

1) Introduction to employment support - the objectives and assumptions of aid for employment subsidization

2) The concept of public aid in the light of Treaty regulations, decision-making practice of the European Commission and case law of the Court of Justice of the European Union

3) Derogations from the general ban on public aid and the conditions for its granting

4) De minimis and public aid under block exemptions

5) European funds (including the European Social Fund) and national operational programs financed from EU funds

6) Conditions for granting aid for subsidizing the employment of disadvantaged and disadvantaged workers

7) Conditions for granting aid for subsidizing employment of disabled workers

8) Payment as an element of the statutory definition of legal employment relationship

9) The concept of remuneration for work as an element of the content of the employment contract, the structure and components of remuneration for work, remuneration and other work-related benefits

10) Protection of remuneration for work (provisions on the form, method and date of payment, protection against deductions, liability of the employer for breach of the obligation to pay remuneration on time and in full, payment order from the labor inspector)

11) Introduction to the subject of employee claims protection - the origin and purpose of the regulation on the protection of employee claims in the event of the insolvency of the employer

12) Organization and financing of the Guaranteed Employee Benefits Fund

13) Subjective scope of the Act on the protection of employee claims in the event of the insolvency of an employer: the concept of employer (Article 2), the concept of employee (Article 10)

14) Catalog of premises for employer's insolvency (mandatory and optional conditions)

15) Catalog of employee claims satisfied from the Guaranteed Employee Benefits Fund

16) Restrictions on benefits paid from the Guaranteed Employee Benefits Fund as to its time of establishment and amount.

17) Procedure for applying for payment of benefits from the Guaranteed Employee Benefits Fund

18) Statutory assignment of claims to the Guaranteed Employee Benefits Fund and the procedure for claiming the refund of benefits paid from employers.

Learning outcomes:

After completing the course the student:

- has knowledge about the EU and national public aid system,

- knows the conditions for granting aid for the employment of workers,

- understands the concept of remuneration for work and can distinguish it from other claims due to employees from the employment relationship

- knows the legal mechanisms provided for in the Labor Code to protect remuneration for work

- knows how to organize and finance the Guaranteed Employee Benefits Fund,

- knows the basic conceptual grid in the field of employee claims,

- sees limitations in satisfying employees' claims from the Fund regarding paid components, their amounts and periods for which they are entitled

- can distinguish types of employee claims satisfied from the Guaranteed Employee Benefits Fund and is familiar with the procedure for applying for the payment of benefits due.

Completing the course for the grade is based on

- the attendance list

- prepared presentation or test / written essay - depending on the arrangements with the lecturer on a given topic
