Prerequisites (description):

Students are required to have general knowledge of the system of national and European law obtained during the first and second year of law studies (in the area of jurisprudence, constitutional law, international law and European Union law, the institutional part).

Short description:

The lecture presents the problems of selected institutions and problems - especially from the general part of civil law - in the light of the jurisprudence of the EU Court of Justice (Luxembourg) and the Constitutional Tribunal and the Court of Human Rights (Strasbourg).

Full description:

The lecture will present the introduction to constitutional judicature (the Polish Constitutional Court), the Strasbourg court (the European Court of Human Rights) and the European Union judicature (the Court of Justice and the EU Court). They will be presented, based on selected case law of the above-mentioned tribunals, the concept of a party to proceedings, judicial and procedural capacity.

With regard to the European Union system - the main axis of reflection will be the process of the Europeanisation of private law. In addition, current matters will be discussed, especially dishonest contract terms and Directive 93/13 of the decision that the court is to investigate ex officio (the Pannon case), at any stage, including execution, can not be hindered by provisions on the pre-trial procedure (Polish case c-176/17 Profi Credit and C-623/17 PKP Bank Polski) or matters of case C-260/18 Dziubak - the case is still before the Tribunal. It turns out that TS is not only from negative integration (the freedom of the internal market), but strives to maintain a high level of protection of individual rights and is now one of its basic motives.

In the part regarding Constitutional Court there will be discussion on such issues as abuse of right, incapacitation and consequences of limitation.

In the part regarding European Court of Human Rights we will focus on freedom of speech and its impact on other (conflicting) rights and human dignity in the context of prohibition of inhuman treatment.

Learning outcomes:

After completing the lecture, the student demonstrates knowledge of the practice of applying law in the field of general civil law institutions, is able to present examples of activities of these institutions from the practice and explain the directions of judicial interpretation of law, knows the relevant judgments of the courts - CJEU, ECtHR and Constitutional Court.

Assessment methods and assessment criteria:

The presence of the lectures, the activity in the discussion and preparation of gloss to the selected decision (homework).
