Short description: |
The concept of the subject should inspire students interested in revealing the historic roots of the institution of the present civil law, mainly created back in the 18th and 19th century. In analyzing the texts, the professor applies a descriptive, comparative text analysis that is outlined according to the classification of translation. |

Subject field: 1. The notion and the genesis of modern civil codifications 2. The idea of modern codification - 18th and 19th century 3. Law of nature and the basic concepts of codification at the turn of the 18th century 4. The history of the codification in Prussia, characterization of ALR 5. Civil Procedural Law of Prussia in the 19th century 6. Codification of ABGB. Systematics of the Code, the personal and material law - the possession and the property 7. Contract Law, and the responsibility for the harm. The Amendments of 1914-1916 8. ABGB - the General Principles of the Civil Code 9. The "Code Napoleon" (1804). The personal law, the secularization of marriage, "the sainthood" of property, the rule of freedom of contracts, the sources of liabilities 10. The direction of jurisdiction. CN (1804) and Civil Procedural Law 11. The General Section of the Code. The liabilities 12. (in Polish) Student będzie potrafić: Wiedza 1. sprawnie operować siatką pojęć i podstawowych instytucji cywilnoprawnych 2. ukazać mechanizm działania prawa cywilnego w zależności od przepisów prawa procesowego Umiejętności 1. wyjaśnić genezę i cel konkretnych rozwiązań prawnych 2. przewidzieć skutki prawne i praktyczne wprowadzania konkretnych rozwiązań ustrojowych Postawy 1. analizować instytucje prawa cywilnego jako wypadkową historycznego rozwoju 2. rozumieć uzasadnienie różnorodnych instytucji cywilnoprawnych w ich kontekście społeczno-historyczno-politycznym. |
Assessment methods and assessment criteria: |
(in Polish) Podstawową formą zaliczenia jest lista obecności oraz aktywność na zajęciach i przygotowanie referatu na wybrany przez studenta temat z zakresu problematyki konwersatorium. |
