The aim of course is presentation of issues of civil procedure concerning legal contacts with foreign countries. This issues compose International Civil Procedure. It is supplement of general science of civil procedure. |
Full description: |
1.Notion, subject and scope of International Civil Procedure. International Civil Procedure Law and other law branches. 2. History and science of International Civil Procedure Law. Sources of law. 3. Problem of classification (characterization). Principles of International Civil Procedure Law. 4. Jurisdictional power and their limitations - diplomatic and state Immunity in examination and enforcement proceedings. 5. Jurisdiction – notion and kinds; connectors; forum non conveniens and forum shopping. 6. International jurisdictional conflicts; effects of lis alibi pendens. 7. Jurisdiction as a procedural requirement. 8. Jurisdiction in particular civil matters pursuant Civil Procedure Code. 9. Influence of parties will on jurisdiction – jurisdictional agreements (prorogation and derogation) and establishing of jurisdiction by entering an appearance. 10. Capacity of foreigners of being a party proceedings and of undertaking procedural actions; procedural situation of foreigners. 11. International judicial assistance (service of documents and taking evidence). 12. Foreign law in judicial civil proceedings. 13. Recognition and declaration of enforceability of foreign judgments – essence of institution; scope of recognition; modes of recognition (automatic recognition and recognition in separate proceedings); conditions and effects of recognition. 14. Essence, scope and conditions of declaration of enforceability; proceedings for declaration of enforceability. 15. International enforcement proceedings law; enforcement of foreign enforcement titles; enforcement proceedings with foreigners; international bankruptcy law. Lecture – 30 h Familiarization with literature and preparing for each lecture – 1 h/week = 30 h Preparing for examination – 30 h In all – 90 h. |
