The lectures present the historical foundations of European legal identity from the Roman Empire to the European Union. In view of the multiple character of this identity the stress lies on the distinction between the common law (British Isles) and the civil law countries (the continent). Within the latter area the gradually disappearing distinction between Eastern and Western Europe is dealt with.

2. The Eastern reception of Roman law: Byzantine law and Justinian

3. The Western reception: mos italicus (the glossators and commentators)

4. Canon law and the papal (Gregorian) revolution of the 11th century

5. The growth of the court-oriented English common law

6. Western influence in Eastern Europe: canon law and German town law

7. Human rights: Pawel Wlodkovic and the Late Spanish Scholastics

8. Legal humanism (mos gallicus) and natural law (the law of reason)

9. The crisis of the ius commune: the German usus modernus pandectarum

10. The older codes: ALR,the French code civil and the Austrian (ABGB)

11. The German Historical School, the Pandectists and the BGB

12. The 19th century: galopping reception of Western law in Eastern Europe

13. European constitutionalism, rule of law and Rechtsstaat in the 19th century

14. Dictatorships of the 20th century: the Soviet and the Nazi regime

Student jest w stanie zlokalizować tradycję europejską na światowej mapie tradycji prawnych, co jest istotne w obecnej dobie prawnej globalizacji. Znajomość podstaw historycznych umożliwia mu zrozumienie obecnych procesów harmonizacji i unifikacji prawa krajów europejskich.

Zajęcia łączą tradycyjną metodę wykładu z elementami pracy własnej studentów. Każdy z uczestników zobowiązany jest do przygotowania prezentacji na wybrany przez siebie temat spośród listy 15 tematów podanych w "pełnym opisie". Jeśli nie uda się przedstawić prezentacji, student składana wybrany temat pisemny esej, który podlega ocenie.
