Private international law: concept, function, methods of regulation; the relevance of the PIL for the implementation of fundamental freedoms and the single market; competences of international organizations - an outline of the issue; historical outline and current state of development of EU competences; competences in the field of the PIL, evolution of treaty provisions; EU relevant legislation; use of the so-called enhanced cooperation; EU international agreements in the field of private international law, participation in the Hague Conference on Private International Law; the contribution of the case law of the Court of Justice to the development of the PIL; Judicial Cooperation in Civil Matters: creation and functioning of the European Judicial Network |

1) Private international law: narrow and broad meaning; relations with the field of international civil proceedings: jurisdiction, recognition and enforcement of judgments in civil and commercial matters 2) Choice-of-law and jurisdictional rules - structure, functions: scope, connecting factors 3) Legal commerce and implementation of Community freedoms: Area of Freedom, Security and Justice 4) Formation of the concept of European private international law: from the 1968 Brussels Convention to the Lisbon Treaty; the role of community / EU case law 5) Competences of the European Union institutions to adopt measures in the field of private international law: art. 81 TFEU 6) Enhanced cooperation as a mechanism used within EU legislation in the field of PPM 7) EU competence to conclude - instead of or in addition to Member States - international agreements in the field of the PIL; analysis of the ECJ opinion on the 2nd Lugano Convention (1/03) 8) Participation of the European Union in the Hague Conference on Private International Law 9) Institutional components of Judicial Cooperation in Civil Matters and their relevance to national civil and commercial court systems 10) Theoretical and practical aspects of the operation of the European Judicial Network in civil and commercial matters: implementation of Council Decision 2001/470 / EC |
