Prerequisites (description): | The aim of the lecture is to present issues related to employment in the public sphere in positions of officialsin the civil service, foreign service, local government, state offices as well as in courts and prosecutor's office. The aim of the lecture is to enable students to acquire knowledge of the subject of legal systems determinants of regulations related to employment in the positions of officials in the public sphere. The course will present differences in the legal status of officials against the background of general labor law regulations in matters such as: grounds for entering into an employment relationship, changes in content and termination of employment, as well as specific duties and responsibilities of officials. |

The lecture covers the following topics: - the origin, concept and subject of employment law in the public sphere and its relationship with administrative law and labor law, - systems for employing officials in the world (career system, job system) - recruitment for officials in the light of the constitutional principle of equal access of citizens to positions in the public sphere - basis of the employment relationship, with particular regard to other grounds of employment relationship than the employment contract (appointment, election, nomination) - scope of nomination as the basis of employment and the problem of protecting the permanence of employment of officials - availability and changes in the content of the employment relationship of officials - termination of employment of officials - specific obligations of officials - legal liability of officials with particular regard to disciplinary liability |

Learning outcomes: |
Students: - know the legislation classified as Civil Service Law (employment law in the public sphere as officials) and are able to interpret the provisions defining the legal situation of officials - recognize the constitutional aspect of the regulations regarding the employment of officials - know the basic institutions of Civil Service Law (employment law in the public sphere as officials) - perceive and understand the distinctiveness of the status of an official against the background of the Labor Code regulations concerning employees |
