Short description:

The aim of the course is to familiarize students with the basic issues of human rights protection in Europe, with particular emphasis on the jurisprudence of the European Court of Human Rights and the Court of Justice of the European Union. Emphasis will be placed on current human rights issues and problems in Europe, available instruments from the perspective of individual freedom and rights.

The aim of the course is to familiarize students with the basic issues of human rights protection in Europe, with particular emphasis on the jurisprudence of the European Court of Human Rights and the Court of Justice of the European Union. Emphasis will be placed on current human rights issues and problems in Europe, available instruments from the perspective of individual freedom and rights. Classes will primarily focus on practical issues related to the evaluation of the current case law and its impact on national law. Various forms of student activation will be used, including case studies and tasks involving the independent formulation of pleadings in international proceedings.

Topics:

1. The interpretation and application of the European Convention of Human Rights and of the Charter of Fundamental Rights of the European Union.

2. Freedom of thought, conscience and religion

3. Freedom of expression in conflict.

4. Dignity.

5. Reproductive rights protection in Europe.

6. Bioethics and human rights protection in Europe. Prawo do czystego środowiska.

7. Right to live in the clean environment.

8. Right to protest (freedom of assembly)

9. COVID and human rights protetion in Europe.

10. Human rights protection in Europe in time of economic crisis.

11. Right to a fair trial by an independent and impartial tribunal in the CJEU and ECtHR case-law.

12. Cultural rights protection in Europe.

13. Human rights protection and new technologies.

14. Sexual minorities rights protection in Europe.

15. Suspects rights protection in Europe.

In addition, part of the course will be devoted to solving case studies, as well as presenting and discussing works prepared by students (individually or in groups) at home.

After completing the course, the student:

KNOWLEDGE:

- has knowledge of freedoms and human rights, in particular the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union

- has knowledge of the functioning of international procedural measures to protect the status of an individual

SKILLS:

- has the ability to independently analyze international legal acts relating to the status of an individual

- has the ability to independently analyze the case-law of European judicial bodies dealing with the protection of human rights

- can identify practical problems in the field of human rights protection, and also propose solutions to these problems

SOCIAL ATTITUDES:

- is aware of the importance of human rights issues requiring international legal protection

Assessment methods and assessment criteria:

The subject is graded. It is based on attendance (40%) and the grade obtained from the knowledge test (60%).

0-59% - insufficient

60-65% - sufficient

66-70% - more than sufficient

71-80% - good

81-90% - more than good

90-100% - very good
